REGULATIONS OF PROMOTION “NOBILE SUMMER CATCHER”

§1

Subject of the Regulations

The subject of these Regulations is to determine the rules of the promotion “NOBILE SUMMER CATCHER” (hereinafter referred to as the “Promotion”).

§2

Promoter

The Promoter is “NOBILE SPORTS” Sp. z o.o. with its registered office in Bielsko-Biała, ul. Wapienicka 6, 43-382 Bielsko-Biała, entered in the Register of Entrepreneurs of the National Court, maintained by the District Court in Bielsko-Biała, VIII Economic Department of the National Court Register under the KRS number 0000321453, NIP 5472099824, REGON 241076730, shared capital PLN 100,100 (hereinafter referred to as the “Promoter”).

§3

Conditions of Participation in the Promotion

  1. This Promotion can be participated by individuals who:
  1. are at least 18 years of age,
  2. have accepted these Regulations,
  3. during the Promotion period
    1. have published their photo presenting summer preparation related to kiteboarding and/or Nobile products on their Facebook and/or Instagram account (hereinafter referred to as the “Photo”),
    2. have tagged the Promoter’s profiles in their post containing the Photo:

            iii. have included in their post with the Photo the hashtags #NobileSummerCatcher and #NobileKiteboarding,

            iv. have completed the form available on the website https://shop.nobilesports.com/nobilesummercatcher and have provided the following data:

  • first name and surname,
  • email address,

             ii. have given their consent to use the Photo and their image by Nobile for marketing purposes determined in the § 4,

            iii. have not deleted the post or the Photo, referred to in point i, or the tags or hashtags, referred to in point ii and iii, and have not withdrawn their consent, referred to in point iv until the day of 23 September 2023,

            iv. have set the audience of the post with the Photo in a way that the post is visible for all Facebook or Instagram users (depending on the site on which the photo was published),

             v. are not employees or coworkers of the Promoter, and are not spouses, children or siblings of these employees or coworkers.

     2. The Photos should comply with the following conditions:

    1. The Photos should be related to the topic of summer preparations,
    2. The Photos should be related to the topic of kiteboarding,
    3. The Photos may not include contents which are illegal or contrary to good practices, especially they cannot contain any contents which are pornographic, offensive, constituting a provocation to commit an offense, violating personal goods or copyrights of other persons.

    3. In the event that there are other people visible in the Photo apart from the Promotion participant, the Participant is obliged to obtain the consent of these people to use their image by the Promoter on the principles determined in these Regulations and to provide them with the information clause included in the Annex no. 1. The above-mentioned condition is not applicable to situations where other people visible in the Photo are only part of a larger whole (for instance, beachgoers in the background, party participants in the background).

    4. By publishing the Photo, the participant declares that he/she holds the proprietary copyright to the Photo as defined in the Copyright Act of 4 February 1994 on Copyright and related rights (Journal of Laws of 2022, item 2509, as amended), to the extent necessary to use the Photo in accordance with these Regulations, especially with the conditions determined in the § 4.

§ 4

Use of Photos by the Promoter

  1. By publishing the Photo on the principles determined in the § 3, the Participant provides the Promoter with a royalty-free, non-exclusive license for the period of five years to use the Photo by the Promoter throughout the world in the following fields of exploitation:
    1. reproduction or copying in any chosen technique, including printing, reprographic, magnetic recording and digital technique,
    2. introduction to the memory of a computer or other devices serving to store data,
    3. distribution on the internet (especially on the Promoter’s website and on the social media with the Promoter’s profiles), distribution in the paper and digital press, broadcasting and communication to the public,
    4. leasing, hiring, public presentations and broadcasting, as well as sharing with third parties, either in paid or unpaid manner,
    5. creation of adaptations, cropping, editing, using as an element of a greater composition, especially by creating advertising materials in any form,
    6. trade in copies of the Photo recorded in any form, in paid or unpaid manner, 
    7. sublicensing,
    8. giving consent for exercising derivative rights.
  2. Modifications introduced by the Promoter in the Photo may not violate the dignity of the Participant or of any other individuals present in the Photo.
  3. By publishing the Photo on the principles determined in the § 3, the Participant grants the consent to disseminate the image recorded in the photo. The consent covers such forms of image dissemination as: sharing on the Promoter’s website and social media (especially Facebook, LinkedIn), sharing on other internet services (especially YouTube), publishing the image in the Promoter’s information and promotion materials (especially in the newsletter), publication in trade media or in other sources, according to the Promoter’s choice – in order to promote the Promoter, to advertise his products and services and to build his positive image.
  4. The image of the Participant recorded in the Photo may be used in various forms of digital image processing, cropping or composition modification; it may also be combined with an image of a different person or completed by some explanatory comments, with no obligatory approval of the final effect. The Promoter holds the sole right of deciding on the form and time of image use in total or in some freely chosen elements.
  5. The consent to use the image is unpaid and shall apply to publicizing of the image on multiple occasions, with no temporal or territorial limitations. Granting consent is voluntary, yet indispensable to participate in the Promotion.

§5

Prize

  1. The prize in the Promotion is a unique discount code to use in the internet store of the Promoter available at the address shop.nobilepsorts.com.
  2. The discount code entitles to a discount of 23% to all products labeled with the attribute “2023 collection”, provided that the products will be ordered in the period from 23 June 2023 until 23 September 2023.
  3. The discount code will be sent to the Participant on the day of 23 June 2023 to the email address provided in the form referred to in the § 3 subparagraph 1 letter c point iv, in the form of an email message.
  4. Each Participant who has published the Photo on the principles determined in § 3 is entitled to obtain the discount code.
  5. The discount code can be only used once.
  6. In the event of withdrawal from the sales agreement concluded with the use of the discount code on the principles determined in the Law on Consumer Rights of 30 May 2014 (Journal of Laws of 2020, item 287, as amended), the Participant does not have the right to reuse the code.

§6
Information on Sending the Prize

  1. The message referred to in § 5 subparagraph 3 constitutes some digital content as defined in the Law on Consumer Rights of 30 May 2014 (Journal of Laws of 2020, item 287, as amended).
  2. The message constitutes a file with figurative and word elements, containing links to the Promoter’s online store website and its subpages.
  3. The sender of the message is the Promoter.
  4. In all matters concerning sending of the message, especially in the case of reservations about the manner of sending the message, problems with its display or malfunction of the discount code provided in this message, the Participant may contact the Promoter via traditional mail or in person to the address specified in § 1, and also via email to the address marketing@nobilesports.com or by telephone at the number +48 795 580 952.
  5. The discount code is shared with the Participants in exchange for the publication of a Photo on the principles determined in § 3.
  6. The Promoter is responsible for transferring the message to the Participant, for its proper display, for the proper functioning of the discount code included in the newsletter and for the compliance of the message with these Regulations. If the Participant does not receive the message or if the message does not comply with these Regulations, the Participant has the right to demand that the Promoter sends a new message with a properly functioning discount code. The new message shall be sent to the Participant within 14 days from the receipt of the demand, provided the request was made not later than on 9 September 2023. 
  7. In order to properly use the message and the included discount code it is necessary to:
    1. have a computer or a mobile device (such as a smartphone or a tablet) with internet access and operating system such as Windows, Android, iOS or Linux,
    2. possess an active email address,
    3. use an updated browser:
      1. Google Chrome,
      2. Mozilla Firefox,
      3. Microsoft Edge,
      4. Opera,
      5. Safari,
    4. have an account at the Promoter’s online store on the day of making purchases with the use of the discount code

- in case of non-compliance with the above-mentioned technical requirements the Promoter does not guarantee proper functioning of the message and the discount code included.

§7
Duration of the Promotion

  1. The time to publish the photo lasts from the day of 7th of June 2023 until the day of 22nd of June 2023. 
  2. The discount code may be applied from the day of 23rd of June 2023 until the day of 23rd of September 2023.

§8
Final Provisions

  1. The Annexes form an integral part of these Regulations.
  2. The Promoter reserves the right to introduce amendments to these Regulations by publishing modifications on the Promoter’s website available at the address https://nobilesports.com/ and by sending to the Participants, who have already completed the form mentioned in § 3 subparagraph 1 letter c point iv, an email message with some information about the amendment in Regulations and with a link to the updated version of the Regulations.
  3. The Promoter may amend the Regulations only for objective reasons which he could not have foreseen at the start of the Promotion and which he could not have prevented using reasonable efforts. The reasons to amend the Regulations may be:
    1. force majeure (natural disasters, epidemics, strikes, fires and wars),
    2. legal acts issued by authorized state authorities or by international organizations authorized to issue legal acts applicable directly on the territory of Poland,
    3. decisions of administrative institutions or state courts operating on the basis of an act.
  4. In matters not regulated by these Regulations the legal provisions of the Polish law shall be applicable, especially the provisions of the Civil Code. 

Annex no. 1

INFORMATION CLAUSE FOR THE PARTICIPANTS

1. Administrator of the Personal Data

Your personal data is administered by the company “NOBILE SPORTS” Sp. z o.o. with its registered office in Bielsko-Biała, ul. Wapienicka 6, 43-382 Bielsko-Biała, entered in the Register of Entrepreneurs of the National Court, maintained by the District Court in Bielsko-Biała, VIII Economic Department of the National Court Register under the KRS number 0000321453, NIP 5472099824, REGON 241076730, shared capital PLN 100,100 (hereinafter referred to as the “Administrator”).

You may contact the Administrator in person, via traditional mail at the address specified above, at the email address marketing@nobilesports.com or by telephone at the number + 48 795 580 952.

2. Purpose and legal basis of personal data processing

Your personal data is processed in order to enable you to participate in the promotion “NOBILE SUMMER CATCHER” and to send you the prize.

The legal basis for the processing of your personal data is your consent (Article 6(1)(a) GDPR).

Provision of your personal data is voluntary, yet indispensable in order to participate in the promotion.

3. Scope of personal data processing

The Administrator processes the following personal data:

  1. image,
  2. first name and surname,
  3. your Facebook or Instagram account name,
  4. email address,
  5. other personal data that you provide in the form or in the description of the post in which you include the photo submitted for the promotion.

4. Personal data recipients

The Administrator may transfer your data to other entities, especially to:

  1. entities providing the Administrator with IT services, website hosting services, preparation of marketing materials services,
  2. operators of social media on which the Administrator has the accounts,
  3. entities providing the Administrator with mailing services (in order to send the message containing the discount code),
  4. individuals who have expressed interest in obtaining marketing materials from the Administrator in which the image of the Administrator has been used.

If your data is transferred to a country outside the European Economic Area, the Administrator ensures that such a transfer occurs on a basis of a solid legal ground, with the use of all the necessary protective measures.

5. Processing time

Your personal data shall be processed by the Administrator to the date of consent withdrawal, however no longer than five years from the date of completing the form. 

6. Your rights

You have the right to:

  1. request access to your personal data,
  2. rectify the data,
  3. delete the data,
  4. withdraw consent to processing your personal data,
  5. complain to a supervisory authority – President of the Personal Data Protection Office.

You can exercise your abovementioned rights by contacting the Administrator in the manner determined in point 1.

The withdrawal of your consent to processing personal data does not affect the lawfulness of the processing of personal data before the date of its withdrawal.
